China’s courtrooms have little time for empathy and understanding. The justice system tends to operate swiftly and dispassionately – evidence is analyzed, judgment is passed, and those found guilty are dealt with severely. Yang Bin, an officer with China’s procuratorate, subscribed to this very system, until a chance encounter at a bus stop.

One day, several years ago, Yang was waiting for the bus home from work, when she noticed an old man standing outside the courthouse holding a small child. As a police car pulled away from the courthouse, the old man patted the sleeping child to wake him. Yang later discovered that a handcuffed man in the back of the police car, a murder suspect, was the child’s father. The old man, the child’s grandfather, had been trying to wake the boy up, afraid it may have been his last chance to see his father, who he had never met.

Tears in her eyes, Yang found herself hoping that the man would not be sentenced to death.

To her relief, he was later granted reprieve. But the scene nevertheless haunted her – eventually, she came to a realization that was to define her career: Criminals also deserve to be treated humanely.

Mercy Project

In 1970, Yang was born into a working class family in Xiangtan, in central China’s Hunan Province. After graduating from Chongqing University, she worked as a secretary for a local State-owned enterprise, before moving to Guangzhou in the south, in search of better job prospects. In 1992, she found work at a local procuratorate in Guangzhou despite having no background in the legal field, becoming the first college graduate ever to work there. She threw herself head-first into the study of law, and quickly caught up with her colleagues, and at the age of 28 began to handle criminal cases. Several years later, she was promoted to a position with the Guangzhou Municipal People’s Procuratorate. In her first six months in the job, she approved four death sentences.

At that time, China’s legal system was very clear in its view of offenders– the justice system was diametrically opposed to offenders, and existed solely to punish wrongdoing. This was the context in which Yang went about her work.

In March, 2013, Yang visited a rural family in Hainan Province. Both grandparents were in their 70s, the parents were in their 40s, and the family’s young son was working as a migrant laborer. Five years previously, the boy’s elder brother had been killed in a fight with a group of his fellow workers, and the case had been assigned to Yang.
